Terms governing your use of this website and the lead-generation services provided through it.

Introduction

These Terms of Service (“Terms”) govern your access to and use of hardmoneyloansparkcity.com (the “Site”) and any services made available through the Site. The Site is operated by Lead Skills, LLC under the brand “Hard Money Loans of Park City.” By accessing or using the Site, or by submitting an inquiry through the Site, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Site.

Our Role: Lead Generation Service

The Site is a lead-generation service. We connect individuals inquiring about hard money financing with participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including whether to approve financing and the rates, terms, and conditions of any loan, are the responsibility of the participating lender. All loan programs are subject to borrower and property qualification by the participating lender. Participating lenders' rates, terms, and conditions vary and are subject to change without notice. Not all applicants will qualify. A current list of participating lenders is available upon request.

No Offer or Solicitation

Nothing on the Site constitutes a loan offer, a commitment to lend, a solicitation to enter into a loan, or legal, financial, tax, or accounting advice. Information on the Site is provided for general informational purposes only and may not reflect the offerings of any particular participating lender. Submitting information through the Site does not guarantee that you will be matched with a lender or receive a loan offer.

Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Site. You agree to provide accurate, current, and complete information in any form you submit and to update that information as necessary to keep it accurate, current, and complete.

Your Consent to Be Contacted

By submitting an inquiry through the Site and checking the consent box on the contact form, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text message, by asking to be removed during any call, or by contacting us using the information below.

Hard Money Loans of Park City connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms or applicable law.
  • Submit false, misleading, or fraudulent information.
  • Submit information on behalf of another person without that person's authorization.
  • Attempt to gain unauthorized access to the Site, any related systems, or other users' data.
  • Introduce viruses, malware, or other harmful code.
  • Interfere with or disrupt the operation of the Site, including by scraping, crawling, or overloading our systems.

Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Lead Skills, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of the content on the Site without our prior written consent, except as expressly permitted by these Terms.

Third-Party Links and Services

The Site may contain links to websites, products, or services operated by third parties, including participating lenders. We do not control and are not responsible for the content, accuracy, privacy practices, or terms of those third parties. Your interactions with any third party, including any participating lender, are solely between you and that third party. We encourage you to review the terms and privacy policies of any third party before engaging with them.

THE SITE AND ALL CONTENT AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LEAD SKILLS, LLC, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, ANY CONTENT, OR ANY INTERACTION WITH A PARTICIPATING LENDER. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

You agree to defend, indemnify, and hold harmless Lead Skills, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, your violation of any law or the rights of any third party, or your interactions with any participating lender.

Governing Law

These Terms and any dispute arising out of or relating to them or the Site will be governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. The exclusive venue for any action or proceeding arising out of or relating to these Terms or the Site will be the state or federal courts located in Summit County, Utah, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date above. Your continued use of the Site following an update constitutes your acceptance of the updated Terms.
